Commercial Law and Practice provides a detailed guide to the four major elements of commercial law and practice. Part I offers a thorough introduction and overview of commercial agreements; Part II tackles the additional problems created when drafting international sales agreements; Part III introduces the protection and exploitation of intellectual property and Part IV outlines the general principles of competition law and examines how it may affect the drafting and operation of commercial agreements.
This new edition has been fully updated to take into account all recent developments, and there has been considerable revision of the Intellectual Property section, with references to Nova Productions Ltd v Mazooma Games Ltd (copyright), Dyson Ltd v Qualtex (UK) Ltd (designs), Douglas v Hello! Ltd (confidential information) and British Sky Broadcasting Group plc v Sky Home Services Ltd (passing off). There is discussion of the changes in registration practice for trade marks in the United Kingdom, and consideration of recent case law in that area.
The chapter on agency and distribution agreements has been updated to take account of the House of Lords’ decision in Lonsdale v Howard & Hallam Ltd, and the consumer credit chapter reflects the ongoing changes to consumer credit law brought about by the Consumer Credit Act 2006.
